These Terms & Conditions apply to all services provided by Jadore Pte. Ltd. (hereinafter referred to as “the Company”), including various game applications and the generative AI-based digital content creation service, “ExArt.” By using any of the Company’s services, users agree to these terms. Please note that users located within the European Union (EU) are not permitted to use the Company’s services.
1. License and Use
1.1 The Company grants users a non-exclusive, non-transferable, non-sublicensable license to use the services solely for personal, non-commercial purposes. In particular, digital assets generated by the generative AI service “ExArt” (including images, videos, and text) are strictly prohibited from being used for commercial purposes and are intended for personal use only.
1.2 Users are not permitted to copy, modify, reverse engineer, decompile, or attempt to extract the source code of the services. All copyrights and intellectual property rights related to the services remain with the Company or the respective rights holders.
2. Restrictions
2.1 Users must not engage in any activities that violate laws, harm others, or compromise the security and integrity of the services.
2.2 All digital assets provided by the services, including those generated through ExArt, are limited to personal use only. Commercial use, distribution, sale, or leasing of the digital assets is strictly prohibited.
2.3 Users located in the European Union (EU) are prohibited from using the Company’s services. Any attempt to access or use the services from within the EU will result in immediate termination of the user’s access.
3. Updates and Changes
3.1 The Company reserves the right to modify, update, or discontinue any of the services without prior notice. Continued use of the services after any changes indicates acceptance of the modified terms.
3.2 Users are required to accept updates to the services as provided. Failure to accept updates may result in limited functionality or access to the services.
4. Internet Connection
4.1 Certain features of the services require an active internet connection. The Company is not responsible for the functionality of the services if users experience connectivity issues.
4.2 Any data or network charges incurred while using the services are the responsibility of the user. This includes charges for data usage while roaming.
5. Third-Party Services
5.1 The Company’s services may integrate with third-party content, services, or advertising. Users acknowledge that any third-party services are subject to the terms and policies of those third parties, and the Company assumes no responsibility for these services.
5.2 Intellectual property rights for third-party content are retained by the respective providers. Users must comply with the intellectual property rights of those third parties when using the content.
6. Registration and Passwords
6.1 Some services may require account registration. Users are responsible for maintaining the confidentiality of their account credentials and for all activities conducted under their account.
6.2 In case of suspected unauthorized access, the Company reserves the right to suspend the account or take necessary actions to protect the security of the services.
7. Service Interruptions and Termination
7.1 The Company reserves the right to temporarily or permanently interrupt services without notice for security, technical, or operational reasons.
7.2 Upon service termination, users are required to cease using the services and remove any related applications or content from their devices.
8. Disclaimer
8.1 The Company does not guarantee uninterrupted, error-free, or fully secure services. Users agree to use the services at their own risk, and the Company is not liable for any data loss or damage arising from service use.
8.2 Users are responsible for ensuring that their use of the services complies with all applicable local laws in their respective jurisdictions.
9. Governing Law and Dispute Resolution
9.1 These terms are governed by the laws of Singapore. Users residing outside of Singapore acknowledge that Singapore law applies to these terms regardless of their local jurisdiction.
9.2 In the event of any disputes arising from these terms or the use of the services, the courts of Singapore shall have exclusive jurisdiction. However, applicable consumer protection laws in the user’s country of residence may also apply where required, except for users located in the European Union.
9.3 Both parties agree to first attempt an amicable resolution through good faith negotiations before escalating the dispute to formal legal proceedings.
10. Privacy
10.1 The Company may collect and use technical data and related information, including but not limited to information about your device, system, application software, and peripherals. This information may be gathered periodically to facilitate the provision of software updates, product support, and other services related to the service. This information will be handled in accordance with the Company’s Privacy Policy.
10.2 Information provided by users through reviews, social media posts, or other similar communication channels may be publicly available, and usernames may be disclosed. If users do not wish for their information to be used for promotional purposes, they should contact the Company to opt out.
10.3 The Company reserves the right to monitor communications between users for security and training purposes but is under no obligation to do so. Inappropriate content may be removed at the Company’s discretion.
10.4 If users post reviews or content on platforms where the services are distributed (e.g., app stores, marketplaces), they must comply with the terms and policies of those platforms.
11. Intellectual Property Rights
11.1 All intellectual property rights related to the services, including digital assets generated through ExArt, remain the property of the Company or the respective third-party providers. These digital assets are for personal, non-commercial use only.
11.2 Users must not infringe on the intellectual property rights associated with the services. Reverse engineering or attempting to synchronize the services with other programs or systems is strictly prohibited.
12. Limitation of Liability
12.1 The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of the use or inability to use the services.
12.2 The Company’s liability for any claim related to the use of the services is limited to the amount paid by the user for accessing the services.
